Users of patient.info (the “Website”) can purchase additional services from the operator of this Website Egton Medical Information Systems Limited (“EMIS”), which trades as patient.info.

1. General

These Terms and Conditions apply to users of the Website who wish to purchase any of the PatientPro Services detailed below at clause 4 (the “Services”).

Acceptance by EMIS of your order to purchase any of the Services is conditional upon acceptance by you the customer of these Terms and Conditions.

2. Order Process

To purchase any of the Services you should follow the online ordering process on the Website.

To be able to order any of the Services you must have a valid active PayPal account.

You may upgrade the Services which you purchase from EMIS at any time via the online ordering process.

3. Order Confirmation

EMIS will acknowledge acceptance of your order and subject to such acceptance the Service shall commence immediately following such order. If the Services have not started within twenty-four (24) hours of your receipt of EMIS’ acceptance then please contact EMIS at: clinicalcontent@patient.info

4. Services

You will be prompted to select from the following four Services, full details of which are on the Website:

  • Free Account –bookmark pages
  • PatientPro Tracker – features include bookmark pages, add notes, track all pages you have viewed, view and export notes and logs of pages viewed
  • PatientPro No Ads – features include bookmark pages, remove all third party advertising from patient.info except for one (1) message from sponsor. For the avoidance of doubt, the ‘MyHealth’ website at https://myhealth.patient.info and the ‘Shop’ website at http://shop.patient.info will still display adverts with this option.
  • PatientPro Complete – features include bookmark pages, add notes, track all pages you have viewed, view and export notes and logs of pages viewed, Pro right menu on all clinical articles, remove all third party advertising from patient.info except for one (1) message from sponsor. For the avoidance of doubt, the ‘MyHealth’ website at https://myhealth.patient.info and the ‘Shop’ website at http://shop.patient.info will still display adverts with this option.

5. Prices

The price of the Services is as follows:

  • Free Account – Free of charge
  • PatientPro Tracker – £2.99 per month
  • PatientPro No Ads – £2.99 per month
  • PatientPro Complete – £4.99 per month

These prices are inclusive of VAT.

Should you upgrade the Services at any time then you will be charged a pro-rated charge of the upgraded Service for the billing month in which you choose to carry out such upgrade. At the start of the following billing period the fees will be charged at the level of the upgraded Service.

6. Payment

Payment for the Services shall be taken via PayPal in advance for the month, and will recur on the monthly anniversary of the purchase date for each subsequent month of the Service, until the Service is cancelled pursuant to clause 11.

No other payment methods are accepted.

No refunds on the payments shall be granted.

Should you fail to make payment then EMIS may terminate the provision of the Service immediately.

7. Intellectual Property

All Intellectual Property Rights in and to the Services, including without limitation any copyright relating thereto, is and shall remain the property of EMIS.

8. Support

Should you have any problem with the Service then you should contact EMIS at: clinicalcontent@patient.info

9. Data and Data Protection

EMIS will comply with the Data Protection Act.

Following your cancellation of the Services all data which you input during your use of the Services shall be deleted. EMIS is not responsible for retaining this data and should you not want to lose this data then you should export the data prior to cancelling the Services.

NO DATA OF A PERSONAL NATURE IN RELATION TO YOU AND/OR ANY THIRD PARTY (INCLUDING WITHOUT LIMITATION YOUR PATIENTS IF YOU ARE A MEDICAL PRACTITIONER) SHOULD BE INPUT BY YOU DURING YOUR USE OF THE SERVICES.

10. Customer Obligations

At all times when dealing with EMIS we expect that you will be co-operative and courteous.

11. Cancelling the Services

You may cancel the Services at any time by signing in to the Website and following the online cancellation from ‘My account > Manage your subscription’.

EMIS may cancel the Services at any time by written notice to you, including via email.

Upon cancellation, the services will remain active until the end of the current monthly billing period. No refunds on the payments shall be granted.

Should you fail to make payment of the appropriate fees then EMIS may terminate the provision of the Service immediately. Should you misuse the services in any manner then EMIS may terminate the provision of the Service immediately.

Should the Services be cancelled then your attention is specifically drawn to the provisions of clause 9 in relation to the potential loss of data.

12. EMIS Liability

EMIS shall not be liable to the Customer for any loss or damage whatsoever arising directly or indirectly in connection with these Terms and Conditions or the Services. EMIS expressly excludes liability for consequential loss or damage, or for loss or profit, business revenue, goodwill or anticipated savings. In any event that exclusion of liability contained in these Terms and Conditions shall be held invalid for any reason, EMIS will only become liable for loss or damage limited to the fees paid to EMIS by you in relation to the Services.

13. General

EMIS shall be under no liability to the Customer in respect of anything which, apart from this provision, may constitute breach of this Agreement arising by reason of force majeure, namely circumstances beyond the control of the Supplier which shall include (but shall not be limited to) acts of God, perils of the sea or air, fire, flood, drought, explosion, sabotage, accident, embargo, shortages or production problems.

If any provision (or part of a provision) of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force.  If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the intention of the parties.

A waiver of any right under these Terms and Conditions is only effective if it is in writing and it applies only to the party to whom the waiver is addressed and to the circumstances for which it is given.

These Terms and Conditions are construed in accordance with English law. By ordering the Services you irrevocably agree that the courts of England have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Services (including non-contractual disputes or claims).

These Terms and Conditions do not confer any rights on any person or party (other than the parties to this agreement and (where applicable) their successors and permitted assigns) pursuant to the Contracts (Rights of Third Parties) Act 1999.
